The products featured on this website are designed and hand-crafted by the Comfort Works team. We create templates from scratch for every cover and every brand. Our beautiful and practical fabrics are selected and tested in-house, and are different from the standard textiles of the sofa manufacturers.
 

Terms & Conditions

Welcome to the place where a lawyer gets the company to write a bunch of boring, yet incredibly important stuff to keep me and you on the same page. Hopefully we'll be able to summarise most of the content here into a more succinct blurb.

We're an Aussie company which ships internationally. This means you're bound by Aussie laws and the products you order from us will be affected by your local import laws (customs duties). There would of course, be differences in the way things are done between countries so when in doubt, just drop us a message and we'll talk things over.

If we made a mistake on your order we'll do our best to make it right. Even if there wasn't a mistake but you have an issue or question, we'd definitely like to help you find a solution of some sort.

We'll be straight up with you and hope you return the favour -- this means double-confirming that you liked the swatches before ordering the slipcover, taking as much care with your order as we will be making them.

Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to the following terms, conditions and notices (the "Terms of Service").

By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. Comfort Works reserves the right to update or modify these Terms and Conditions at any time without prior notice. For this reason, you should check this page regularly to take notice of any changes we may have made to the Terms of Service.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.

Your use of the COMFORT WORKS website (comfort-works.com) constitutes your agreement to follow these rules and to be bound by them. If you do not agree with any of these terms and conditions, please refrain from the use of COMFORT WORKS website.

Terms of sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and can be subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with COMFORT WORKS you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us.

COMFORT WORKS retains the right to refuse any request made by you. If your order is accepted we will inform you by email and we will confirm the identity of the party which you have contracted with. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.

Our contract
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. Any typographical, clerical or other error or omission in any sales literature, quotation, acceptance of offer, invoice or other document issued by us will be subjected to correction without any liability on our part.
Pricing & availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund, all within 30 days of payment. Delivery costs are waived for most countries except for a select few; such additional charges will be clearly displayed upon checkout where applicable and included in the Total Cost.

All import taxes are included, no further charges on receiving the order in the EU and the UK.
For all remaining countries taxes are not included and custom fees might occur.
Payment
I. We require payment in full before production of Goods. Your card will be debited once the order has been accepted. Your estimated delivery date (typically 3-4 weeks) starts on the date payment has been received.

II. We are an Australian-based company but use a payment processing service based in Singapore. As such, transactions may or may not result in foreign transaction fees which are charged by your financial institution and not by Comfort Works. Comfort Works is not responsible for bearing these foreign transaction fees.
Product specification
I. We have a policy of continuous product development and reserve the right to amend the specification of Products without prior notice in relation to future sales. Goods supplied may differ as consequence from those on display or advertised. Unless agreed with you, the Goods supplied will be of equivalent value, functionality and appearance. Any significant variations will be highlighted on the Website.

II. Leather Products are made from quality bycast natural leather and accordingly they may not be uniform in colour or texture. Some leathers will mellow with age and exposure to sunlight and heat.

III. We will endeavour to match the colour and texture of the fabric of your sofa to the samples chosen as accurately as possible, but variations in dye lots may occur, especially in naturally dyed fabrics such as the linen and cotton.
Measurements
All made-to-measure Products are made to fit based on the measurements you have provided and are made to order and therefore cannot be cancelled or altered once the order is being processed without incurring a restocking fee. We will ensure as much guidance as necessary in ensuring the measurements you provide are accurate enough for us to produce your sofa covers. For non-made-to-measure Products, please check overall and general measurements against their product descriptions before placing an order and expect up to 2.5cm/1" variance as these values are approximate. Should the variance be larger, please contact us.
Delivery
I. Time of delivery is not of the essence in this Agreement. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of COMFORT WORKS or delay due to any reasonable rescheduling of delivery.

II. Import Duties/Custom Fees/Tax Charges- You as the importer are responsible for assuring that the product can be lawfully imported to the destination country. When ordering from Comfort Works, the recipient is the importer of record and must comply with all laws and regulations of the destination country. International shipments may be subjected to import taxes, customs duties, and fees levied by the destination country, fees that are again the responsibility of the importer. Customs policies vary widely from country to country; you should contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our original delivery estimates.

III : Additional courier charges and administration fees that incur for changing the Shipping Address after Shipment has been made may be covered by Comfort Works, but the customer is liable to repay these expenses incurred while in re-routing/re-delivering your Parcel. If the Parcel is in our custody, we have the right to hold the Parcel until payment has been made before making the address change for you.
Returns & refunds
I. Comfort Works wants every one of your shopping experiences with us to be a positive one, which is why we have a 60-Day 'In Love Again' Guarantee in place. From the date you receive your slipcovers, you have 60 days to make sure they're right for you and your home. If they're not, let us know and we'll make it right with a free replacement. If there's still an issue, we will provide you with another replacement or give you a full refund. For issues regarding fit, fabric performance or constructions, send us an email with the details and we'll get working on your replacement slipcover. We may require you to send us detailed photos and/or measurements so we can make sure your replacement is perfect.

II. If you made an honest mistake or had a change of mind, send us an email and we'll be happy to offer you store credit to the value of 50% of your original order value. This policy can only be exercised once per original order. Read more on our 60-Day 'In Love Again' Guarantee here.

III. Non-textile products such as sofa legs, armrest trays, and wireless chargers would require a short video demonstrating that the product is faulty and cannot be used in order to claim a replacement.

IV. We will not accept claims on monogrammed, personalized, special-order items, items damaged through abnormal wear and tear usage, made-to-measure slipcover orders or fabric orders that have already been cut. We strongly advise that fabric samples be ordered and test before placing a slipcover order with Comfort Works.

V. We will not refund any goods that have been rejected by you. For example, if you have refused to accept delivery and our courier services returns the item to us, we will consider our obligation to attempt further shipment as terminated, reserving all rights against you for resultant damages arising from your failure to fulfill your obligation.

VI. If the delivery of the goods cannot be completed because you were unavailable at your address, and the goods cannot be re-delivered to you despite our attempts to contact you by email, telephone or voicemail, and text messaging, we will consider our obligation to attempt further shipment as terminated, reserving all rights against you for resultant damages arising from your failure to fulfill your obligation.
Cancellations
You are able to amend an order within 1 business day of it being submitted; this only includes changing the size/colour/quantity of an item and changing the delivery address. Full cancellations for any reason are allowed but are subject to 5% processing fees, and a 30% restocking fee should the order have gone into production.

However, all amendments or cancellations for Express orders will be subject to 5% processing fees and a 30% restocking fee because production will commence within 24 hours. We recommend ensuring your Express order details are final prior to payment.

Cancellations are no longer possible if your order has already been shipped.
Fabrics
I. Fabric may vary slightly between dye lot / production batch. Though the actual variation is often very slight, fabrics made from natural ingredients can and will have a colour difference of up to 5%.

II. Whilst we guarantee to make all your order from the same batch, we cannot guarantee that subsequent orders will match your original order due to dye-lots batch variation.

III. The above guarantee will only apply to swatch orders that have been received and order(s) placed within a 30 day time-frame.

IV. We cannot accept any responsibility for fading or discoloration, due to exposure to sunlight.

V. We cannot accept any responsibility for fading or discoloration, due to exposure or contact with any chemicals sprayed nearby or applied directly. Please also note that there are certain aerosol sprays, most particularly odor neutralizers and nicotine neutralizers that contain certain chemicals that can react with fabric dyes.

VI. We recommend that you wash and/or clean your slipcovers as an entire set, as colored fabrics can and will fade slightly after the first wash.

VII. All products are sold on the basis that they are suitable for domestic use only.
Discount codes
Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made through this Website.

Comfort Works only allows one voucher code to be used in a single checkout.
Referral program
I. Comfort Works ("CW" or “We”) offer brand advocates (“Advocates” or “You”) the opportunity to participate in its referral program (the “Program”). We reserve the right to amend or terminate the Program at any time, for any reason. The Program is administered by CW. Advocates are bound by these Terms and Conditions by participating in the Program. By participating in the Program, Advocates agree to use the Program in the manner specified in these Terms and Conditions.

II. Advocate shall receive in his or her CW account one (1) reward (each, a “Reward”) in the form and value determined by CW for each verified Qualified Referral generated by Advocate. A Qualified Referral must purchase a minimum amount of US$150 or of equivalent currency, and have received his/her product(s) in one order to be considered a Qualified Referral. Rewards may be redeemed in various forms in the CW's sole discretion, including, but not limited to in the form of an Amazon.com* gift card.

Internet purchases
I. We endeavor to display as accurately as possible the colors of our products that appear on the website. However we cannot guarantee that your monitor will accurately reflect the color of the product delivered.

II. The contract shall not be concluded until we have received your valid credit card charge or debit card payment details and we have accepted the order by way of a confirmation by return e-mail to the address you have given us during the registering procedure and on ordering.

III. Every effort is made to ensure the complete accuracy of our website however some prices/details may change from time to time and it is possible that error may occur. We will use our best endeavours to rectify any errors as swiftly as possible but we cannot be responsible for any losses incurred.

IV. We are entitled to refuse any order placed by you.

V. We have taken reasonable care in the preparation of the information and content of this website. All information and content are prepared on the basis of publicly available information and other sources which are believed to be reliable. To the maximum extent permissible by law as such, we do not guarantee, and make no representation or warranties of any kind whether express or implied about the information and content provided through our website, including any items used either directly or indirectly. We also reserve the right to make changes and corrections at any time, without notice. We accept no liability for any inaccuracies or omissions in the site and any decisions based on information and opinions contained in the site are the sole responsibility of the user.

VI. Any material downloaded or otherwise obtained through the use of this website is done at your own discretion and risk. You will be solely responsible for any damage to your own computer systems or loss of data that results from the download of such materials.

VII. We control and operate the web site from our offices within Australia. Accordingly the laws of Australia govern claims relating to, including the use of the web site and the materials contained therein. If you choose to access our website from outside Australia you do so on your own initiative and you hereby agree that in the event of a dispute between COMFORT-WORKS.com and you the laws of Australia will apply at all times.
Pre-order purchases
I. When placing a pre-order, you will be required to provide certain information, such as your shipping, billing, and contact information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. We shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information. You can update your information at any time prior to your product being shipped by sending an e-mail to info@comfortworks.com.

II. You will be charged at the time of placing a pre-order. If we are unable to commence shipping of a pre-order product on or before the 90 day anniversary of your placing the pre-order for that product, we will process a full refund to you. Your placing of a pre-order constitutes your express agreement to the company charging of your provided payment method at such time. The purchase price does not include import duties, taxes, transaction fees, other government charges or fees imposed by your individual bank, which are your responsibility.

III. The expected shipping date for pre-order products will be clearly noted on each product page, subject to reasonable delays in manufacturing and/or delivery. Such date is only an estimate, is subject to change, and Comfort Works does not represent or warrant that it will be able to ship the product by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, we will not be responsible for any damages that may occur due to the delay, nor shall we be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. The products will be shipped in the order in which your pre-order is received by Comfort Works.

IV. The purchase of the products is subject to additional terms and conditions provided by Comfort Works, including in respect of any intellectual property embodied in the products. The current Terms and Conditions of Sale can be found on the same page and are subject to change without notice. Your purchase of the product will be subject to these Terms and Conditions and the refund policy
Feedback rebate terms
I. To qualify for a rebate on your slipcover order, you will be required to fill out a feedback survey and submit photos of your sofa in your new Comfort Works Cover. This rebate is only applicable for selected products.

II. After your feedback is received, our Comfort Works product manager will contact you with the possible option for a free replacement cover on parts that could be improved. You may be required to re-measure your sofa or take additional pictures of your sofa to qualify for the rebate. We’ll work with you until the fit is perfect.

III. The rebate will only be processed if our Technical Pattern Makers have deemed your sofa cover a perfect fit.

IV. If feedback is found to be insufficient or not provided timely, the offer will be withdrawn.

V. The rebate will occur via the same method for purchase

VI. This rebate doesn’t cover change of mind for the fabric or colour. Additional costs will incur.
Construction warranty
Our one (1) year Construction Warranty is only applicable for the following:

I. Zippers (e.g. zipper head breaking, zipper tracks going out of alignment, zipper tracks bending, zipper heads derailing etc)

II. Snap buttons

III. Velcro (e.g. functionality of velcro, velcro coming off the covers)

Send us photos of the damaged parts so we have a clear idea of what might have happened. If you're eligible to claim our Construction Warranty, we will be sending you a fabric sample first to check if the colour of the sample still matches your slipcover. If it matches, we will only replace part of the slipcover that is faulty (e.g. just the arm piece, cushion cover or frame). However, if the colour does not match, we will replace your entire slipcover with the same fabric (and a new colour of your choice).
Electronics warranty
For electronics such as the wireless charger, Comfort Works offers a one (1) year Electronics Warranty applicable on the wireless charging unit, so simply email us should any issue arise. Please note the following:

I. When contacting Comfort Works for assistance, you will be requested to perform some troubleshooting actions or tasks.

II. This warranty does not apply if the product has not been used or assembled in accordance with the instructions given.

III. This warranty does not cover any externally exposed parts that are scratched or damaged due to normal use.

IV. This warranty is void if there is evidence of the product being tampered with or used with non-Comfort Works approved accessories.

Privacy & safe shopping guarantee


In a few areas of our website we will ask you to provide personal details such as your name and email address. This will only happen when it enables us to provide a better service to you. For example: for your personal order history on our feedback forms.

We do not sell, trade or rent your information to others. You can be sure it will remain confidential and will be used only to help us build a better relationship with you.


Ethical sourcing policy


As a reputable and trusted business committed to offering its customers high quality products, COMFORT WORKS recognizes its obligation to ensure that suppliers are operating ethically.

We expect our suppliers to consistently provide an environment which protects their employees´ health and safety and basic human rights. All suppliers are expected to comply with their national employment laws and regulations with particular regard to:

• Freely chosen employment
• Health and safety
• Freedom of association and the right to collective bargaining
• No discrimination
• No harsh or inhumane treatment
• Working hours
• Rates of pay
• Terms of employment

COMFORT WORKS will never knowingly source stock from countries which are in breach of the above principles. We also look to our suppliers to instil these principles when dealing with their own supplier base.


Intellectual property, software & site usage


You must not misuse this Website. You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person´s proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website.

Breaching this provision would constitute a criminal offense under the Computer Misuse Act 1990. COMFORT WORKS will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.
